What is Negligent Security

May 30, 2020 By Adam Smith

A negligent security claim can be the result of injuries caused by a criminal attack which occurred because a business or property owner failed to provide adequate security or due to injuries caused by overzealous security. Business and property owners have a duty to provide adequate security for customers, employees, guests and other visitors. Necessary security measures can differ by type of business and location as well as other elements that make a crime foreseeable. To find out if you have a case, talk to an experienced Las Vegas premises liability lawyer today.

Common Security Measures

The necessary security measures for each property can depend on many factors such as the type of business, whether it is in a high crime area and whether there is a history of crime on the property. Some examples of common basic security measures include:

  • Security cameras which are functioning and properly placed
  • Proper monitoring of security cameras
  • Adequate lighting in hallways, stairwells, restrooms, walkways, parking lots, parking garages, and other public spaces
  • Properly trained and screened security staff, in adequate numbers
  • Regular, visible patrolling by security staff
  • More than one employee on-site during high-risk hours
  • Panic buttons and emergency phones
  • Bullet resistant enclosures
  • Metal detectors
  • Proper lock and key controls in apartment building, hotels, motels and office buildings
  • Proper building access control
  • Alarm system, including silent alarms where appropriate
  • Prompt and appropriate response to a direct threat

Foreseeability is the Key

The ability to prove foreseeability is crucial to your case. Business and property owners have a duty to provide adequate security, but the duty does not extend to every possible horrible unlikely thing that could happen. There are may factors which can make crime foreseeable, such as:

  • The type of business is high risk, even if it is in a low crime area – examples include banks, ATMs and jewelry stores
  • Property is located in a high-crime area
  • There has been a recent spike in crime in the area
  • There is a history of crime on the property or has been a recent spike of crime on the property
  • A direct threat has been made
